All cases begin in a trial court or in an administrative tribunal. At some point a final decision or judgment will be entered and the proceedings will conclude. At that point, a party unhappy with the outcome can appeal. Even though a party may have won at trial, the winning party may now be faced with defending that outcome before an appellate or supreme court.
